Compliance
with the development standard “Height Limits in Residential Zones’ is
considered to be unreasonable. The
proposed dwelling complies with the maximum height requirement of 9 metres
stipulated within section 3 of the PDCP 2005 and does not adversely
compromise the amenity of surrounding properties. It is considered that the departure from the
development standard in relation to height is acceptable given that the
design of the proposal in relation to height given that the design of the
proposal in relation to bulk & scale will not be excessive and responds
to the locality and to the slop of the site, satisfying the underlying purpose
of the clause. |
