Background:
Council permits charity
organisations to utilise various land throughout the Parramatta Local
Government Area for the placement of charity clothing bins. Presently there are
no formal agreements in place between Council and the respective
charities/organisations. This policy
will provide guidelines for the placement of charity bins on Council land and
privately owned land. The placement of bins may require development consent
under the Environmental Planning and Assessment Act 1979.
Objective:
To establish a policy which sets out information to
charitable organisations Councils requirements for the placement and ongoing
management of clothing bins upon Council owned land and privately owned land
throughout the Parramatta Local Government Area.
Scope:
The policy applies across the entire Parramatta Local
Government Area.

POLICY CONTENT
1 Charity Bins located on Privately
Owned Land
2 Definitions
‘Charity’ shall mean a charity institution or charity
shall be only those organizations authorised by the New South Wales Department
of Gaming & Racing to operate such recycled clothing bins.
‘Clothing Bin Sticker’ shall mean an adhesive sticker
identifying the Charity as specified under Subclause 16(7) of The Charitable
Fundraising Act 1991.
‘NACRO’ shall mean the National Association of
Charitable Recycling Organisations Incorporated.
‘Property Owner’ includes the owner of land, buildings
or premises.
‘Recycled Clothing Bin’ shall mean a portable metal
bin of painted, sturdy construction, with a weatherproof tilt chute at the top
on the front permitting clothing to be deposited, a locked door permitting the
Charity which owns the bin to empty it, and graphic display in accordance with
the provisions of The Charitable Fundraising Act 1991.
3 Administration
The Strategic Asset Management Unit will be responsible for the
implementation and management of the policy.
(a) Design
Each bin is to have a maximum
capacity of 2.2m³ and is to be constructed of a suitable sturdy material.
Bins
must be weatherproof, theft proof and impenetrable.
(b) Painting of Bins
Each bin is to be completely
repainted every two (2) years unless otherwise required by Council’s Manager
Strategic Asset Management.
(c) Wording
on Bins
Each bin is to clearly bear the
name and telephone number of the organization and all information as required
by legislation under the Charitable Fundraising Act 1993.
(d) Appearance
of Bins
All graffiti is to be removed from
bins within one week of placement for non-offensive graffiti and the next day
in the case of offensive/obscene graffiti.
Bins must be kept in good repair
and maintain a neat appearance. Council
reserves the right to direct the replacement of a bin that has been damaged or
dilapidated.
(e) Number of Bins
No more than two bins to be
located in any one location. Where more
than two clothing bins all belonging to member organisations of NACRO currently
contravene this regulation, such members should reach agreement as to removal
of any bins at sites subsequently indicated in writing by Council. Each grouping of bins to comprise either two
different NACRO or non NACRO organizations.
(f) Landscaping
of Land Surrounding Bins
Landscaping suitable to Council is
to be provided to reduce the visual impact of each bin.
(g) Bin
Security
The clothing bins should not
impede sightlines or allow for people to conceal themselves behind them.
Bin locations must be open to
public view and where necessary, well illuminated to discourage vandalism and
rubbish dumping.
(h) Location
(i) Approved Locations
Bins can be
placed in the following locations with the owners consent:
· Privately owned land.
· Council owned land as authorised by Manager Strategic Asset Management.
(ii) Prohibited Locations
· Footpaths or road reserves
· Any location that requires a vehicle to use a public road as a parking
area to enable placement of clothing into bins where parking in that location
would be contrary to RTA and Council signs.
(iii) Bin Group Spacing
To
reduce adverse visual impact of any location, each cluster of bins must be
separated by a distance of 100m.
(iv) Foundations
Bins
are to be placed on an even or near-level foundation and must be secured to
eliminate the chance of their being tipped over.
(v) Parking
There
must be an adequate space in close proximity to each bin for patron parking.
(i) Performance
Bins
must be maintained on a regular basis, minimum servicing weekly, and excess
clothing and dumped rubbish in the vicinity of the bin/s removed within 48
hours.
