REASON FOR REFERRAL TO COUNCIL
The application is referred to Council as it is an application under Section 82A of the Environmental Planning and Assessment Act, 1979.
EXECUTIVE SUMMARY
This Section 82A Review application seeks Council’s reconsideration of its refusal to grant consent for the demolition, tree removal and construction of a multi-unit development containing 3 townhouses.
The original development application was refused under delegated authority by the Group Manager, Outcomes and Development on 18 April 2011 for the following reasons:
1. Insufficient information has been submitted to enable a proper assessment of the application. The following information has not been provided:
· A driveway gradient profile to ascertain whether the driveway grade complies with the requirements of AS 2890.1. · A detailed plan submitted by a civil/traffic engineer showing swept path templates in accordance with AS 2890.1: 2004 and AS 2890.2:2002 in relation to the design of general manoeuvring for parking spaces and parking aisles within the subject site · An AQF Level 5 arborist report that will identify all trees located within the subject site and all affected trees located on the adjoining properties. · Details of stormwater management to accompany revised architectural plans
2. Section 4.4.3 of PDCP 2005 indicates that to ensure that the ground floor of all dwellings within the site are ‘visitable’ by people with a disability, a continuous path of travel in accordance with the requirements of AS 1428.1 must be provided from the street and the visitor parking spaces. Details of the required ramps including grades has not been provided on revised plans.
3. To promote the design of buildings that are adaptable and flexible in design to suit the changing lifecycle housing needs of residents over time, section 4.4.3 of PDCP 2005 requires developments with 3 dwellings to contain 1 dwelling that are designed in accordance with the requirements of AS 4299. Amended plans demonstrating that 1 dwelling will be constructed in accordance with the requirements of AS 4299 have not been submitted.
The notice of determination was issued on 28 April 2011.
The plans and information submitted with the Section 82A Review have satisfactorily addressed the previous reasons for refusal.
One submission was received in respect of this application. The issues raised within that submission relate to loss of privacy, construction noise, increase in population and loss of views. The issues raised in the submission do not warrant refusal of the application. The issues have been discussed in detail within the Section 79C assessment report contained at Attachment 1.
The application is a permissible use within the zoning applying to the land and complies with the objectives of the R3 Medium Density Residential zone which is the current zoning of the land. The proposed development generally complies with the requirements of DCP2005 and is considered suitable for the site as it does not adversely impact upon the amenity of the streetscape or neighbouring properties.
For the reasons outlined in this report and Attachment 1, it is recommended that Council change its previous decision and approve consent to the Section 82A Review application.

(a) That Council change its determination and approve Development Application No. DA/469/2010 for the demolition, tree removal and construction of a multi-unit development containing 3 townhouses on land at 29 Sophie Street, Telopea subject to the conditions contained in Attachment 1 of this report.
(b) Further, that the person who lodged a submission be advised of Council’s determination of the application.

REASON FOR REFERRAL TO COUNCIL
The proposal is referred to Council for consideration as 14 submissions and 4 petitions objecting to the application have been received.
EXECUTIVE SUMMARY
The application seeks approval for the consolidation of two lots( Lot 5 and Lot 6 of DP 219954) into one lot, demolition of existing dwellings, removal of trees, construction of a four storey residential flat building containing 24 units with two level of basement car park with 33 car parking spaces.
The application was advertised and notified in accordance with Parramatta Council Development Control Plan 2011 and 14 individual submissions and 4 petitions objecting to the proposed development were received. The main concerns raised in the submissions relate to the close proximity of the development to Dundas Public School and related traffic issues. These have been assessed in detail within the Section 79 C report attached (Attachment 1).
The subject site and its immediate surrounding area is zoned R4 High Density Residential under Parramatta Local Environmental Plan 2011 and the proposed residential flat building is permissible.
The proposed development is consistent with the underlying objectives and provisions of Parramatta Local Environmental Plan 2011 and Parramatta Development Control Plan 2011 and is considered satisfactory with respect to design, bulk and scale, privacy, and overshadowing.
After consideration of the development against the relevant statutory and policy provisions, the proposal is considered to be suitable for the site and is in the public interest. Therefore, it is recommended that the application be approved.

(a) That Council as the consent authority grant deferred commencement development consent to Development Application No. DA/746/2011 for consolidation, demolition, tree removal and construction of a four storey residential flat building containing 24 apartments at 4 and 5 St. Andrews Street, DUNDAS NSW 2117 for a period of five (5) years for physical commencement to occur from the date on the Notice of Determination subject to the conditions contained in Attachment 1.
(b) Further that, persons who made a submission be advised of Council’s decision. |
