SUBJECT Draft Parramatta LEP 2010 - Consideration of Submissions

PURPOSE:
To present to Council the results of the public exhibition of Draft Parramatta Local Environmental Plan (LEP) 2010 and to seek Council’s adoption of amendments to the draft LEP. (A separate report will be presented to Council in relation to the draft Parramatta DCP in the near future.)

(a) That Council consider this report, its attachments and all submissions in accordance with section 68 of the Environmental Planning & Assessment Act, 1979. (b) That Council adopt the changes to the draft Parramatta LEP 2010 as outlined in Attachment 2. (c) That the future actions in Attachment 2 be noted. (d) That Council re-exhibit changes to the draft LEP, as are determined to be necessary as discussed in this report, for a period of 28 days and the outcome be reported back to Council. (e) That Council advise the Director General of the Department of Planning of its decision, including advice on those matters that are subject to re-exhibition, and forward the draft LEP to the Department, with the supporting information required under section 68 of the EP&A Act. (f) That the outcome of the separate Planning Proposal relating to 2 Morton Street, be reflected in draft Parramatta LEP 2010 prior to it being finalised by the Department of Planning. Similarly, the outcome of the draft site specific DCP for 2 Morton Street be incorporated in draft Parramatta DCP 2010 prior to it coming into operation. (g) That the CEO be authorised to correct any minor anomalies, typographical errors and the like in the draft LEP, without further reporting to Council. (h) Further, that all persons who made submissions be advised of the outcome.

BACKGROUND
1. The public exhibition of the draft Parramatta Local Environmental Plan (LEP) 2010 & draft Development Control Plan (DCP) 2010 was held from 1 March 2010 to 23 April 2010 and was subsequently extended for an additional 2 weeks with the submission period closing on 7 May 2010.
2. Council received 505 written submissions in response to the public exhibition. A CD has been provided to all Councillors with a copy of all the submissions. This report and attachments provide a comprehensive analysis of the submissions and recommendations arising.
OVERVIEW OF REPORT
(a) A summary and assessment of the submissions is contained in Attachment 3.
(b) Recommended changes to the draft LEP arising from the submissions and internal comments are contained in Attachment 2.
(c) Discussion of key issues raised in the submissions and an explanation of key recommendations are contained in the detailed report in Attachment 1.
3. It is proposed to report the draft DCP to a separate Council meeting in the near future. However, the detailed report (Attachment 1) discusses both the draft LEP and DCP issues jointly where relevant.
ISSUES
4. Under section 68 of the Environmental Planning & Assessment (EP&A) Act, Council may re-exhibit wholly, or in part, any changes it proposes to make to the draft LEP. There are no set criteria in the Act to guide what changes may be re-exhibited. Re-exhibition may not be necessary where Council proposes to make changes arising from the consideration of a submission lodged by the owner of a property, or where a site is in an isolated location and the change will be of minimal impact. Additionally, where the change does not represent a departure from the current planning provisions, re-exhibition may not be necessary.
5. If Council endorses the recommended changes to the draft LEP, the plan would be forwarded to the Department of Planning (DoP), with advice on those matters that are subject to re-exhibition, together with the information required under section 68 of the EP&A Act to enable the DoP to commence consideration of the plan.
6. Following the re-exhibition of elements of the draft LEP, a further report would be prepared for Council to consider any further submissions relating to these matters and subject to Council’s endorsement, these elements of the plan would then be forwarded to the DoP. The DoP would then be able to make a final consideration of the plan as a whole.
TIMING
7. Legislation requires that a re-exhibition of aspects of the draft LEP would be for a minimum period of 28 days. Once the DoP has received all elements of the draft LEP and is satisfied that further amendments are not required, the plan would then be forwarded to the Minister to be made. The timing of this process is difficult to determine. However, it is anticipated that the plan could be made in the first half of 2011.
